Why Safe Pool Fencing Is So Important

There has been an increasing number of tragic, preventable drownings for children in backyard or resort pools throughout South East Queensland. These deaths are most common in children under the age of 5.

Thankfully, in 2010 the Queensland Government introduced legislation to help increase awareness of these tragedies, and offer further prevention by ensuring all pools have safe and well maintained fencing.

As a result of this legislation, John has been able to offer his expertise as a Qualified Pool Safety Inspector, providing quality advice backed up with 35 years of fencing know how.

This is a guide to help check your pool and surrounding area, prior to John visiting for your inspection

Fence
- Your Pool Must Have A Fence And Gate Around The Perimeter
- The Pool Fence Must Be 1.2m High
- Gaps Under Fence No Greater Than 100mm
- No Climbable Objects Outside The Fence Within 1.2m
- No Climbable Objects Inside The Fence For Tiny Feet To Reach Through Fence To Climb Within 300mm Out And 900mm Down

Gates
- Gates Must Open Outwards
- Latch Must Be 1.5m From Ground
- The Pool Gate Must Close From Any Position
- Hinges Must Be .9m Apart Or Bottom Hinged Capped
- Never Prop The Gate Open

Signage
- A Current Resuscitation Sign Must Be Installed Clearly In The Pool Area

Other
- Windows Opening Directly On To Pool Must Be Security Screened Or Screwed Shut
- Doors From House Must Not Open Directly On To Pool. You Can Fence Around Them
- All Fixtures Must Be Secure
- It Is Your Responsibility As The Owner To Maintain Your Pool Fence In Correct Working Order

What Is The Difference Between A Shared And Non Shared Pool

A Shared Pool Is A Multi Tenancy / Resort Pool, Where More Than 1 Person Has Right Of Use

A Non Shared Pool Is Privately Owned / Family Use

We Are Selling Our House, What Should We Do

For A Non Shared Pool, The Seller Must Provide The New Buyer With A Pool Safety Certificate, Or Provide Form 36 At Hand Over.

We Are Buying A New House, What Should We Do

If The Seller Did Not Provide You With A Pool Safety Certificate, A Form 36 Would Be In Place & You Should Have Received A Copy. As The New Owner You Have 90 Days To Obtain A Pool Safety Certificate From The Date Of Settlement With No Extensions Available. When Your Contract Settles, Make Sure You Have Time For Any Repairs Or Modifications If They Are Required. As The Pool Safety Council Has A Record Of Form 36, They Can Fine New Owners Who Don’t Comply Within 90 Days.

You Need To Get Your Pool Or Spa Compliant Between Now And November 2015.

Can Our Local Council Issue Certificates

Local Councils Do Not Issue Pool Safety Certificates. Council Inspectors Issue Infringement Notices If The 90 Day Limit For Non Conformity Notice Expires Without A Pool Safety Certificate In Place And/Or If Complaints Are Made Regarding The Safety Of A Pool.
